Terms of Service

1. About Homing

Homing is a software-as-a-service platform operated by Bouwens Marketing Services ("Homing", "we", "us", "our") that connects an AI assistant to your existing WhatsApp number using WhatsApp's official multi-device feature. By creating an account or using any part of the service you agree to these Terms of Service ("Terms"). If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into a binding agreement to use Homing. By using the service you represent that you meet these requirements.

3. Your account

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at hello@homing.pro if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable use

You may only use Homing to respond to inbound WhatsApp messages from people who have contacted you first. You may not use the service to:

• Send unsolicited bulk messages, spam, or marketing broadcasts.
• Harass, threaten, or deceive any person.
• Violate any applicable law, regulation, or third-party right.
• Circumvent WhatsApp's terms of service or usage policies.
• Resell or sublicense access to the platform without prior written consent.

We reserve the right to suspend accounts that breach these rules without prior notice.

5. WhatsApp compliance

Homing connects to WhatsApp via the official linked-device (multi-device) protocol, the same technology used by WhatsApp Web. You remain solely responsible for ensuring your use of WhatsApp and Homing complies with WhatsApp's Terms of Service and Business Policy. Homing accepts no liability for account restrictions or bans imposed by WhatsApp.

6. Subscription and payment

Homing is offered on monthly subscription plans (Starter, Growth, and Pro). Subscriptions are billed at the start of each billing period. All prices are exclusive of VAT unless stated otherwise. You may cancel at any time; cancellation takes effect at the end of the current billing period and no partial refunds are issued. We reserve the right to change pricing with 30 days' notice.

7. Conversation limits

Each plan includes a monthly limit on the number of unique conversations the AI assistant will handle. Once the limit is reached the assistant will pause until the next billing cycle. You can upgrade your plan at any time to increase this limit.

8. Intellectual property

All software, designs, and content provided by Homing remain the exclusive property of Bouwens Marketing Services You retain ownership of the business information, prompts, and content you provide. By using the service you grant us a limited licence to process that content solely to provide the service.

9. AI disclaimer

Homing provides an AI-powered assistant as a tool to help you respond to inbound messages. AI-generated responses are produced automatically and may occasionally be inaccurate, incomplete, or inappropriate. Homing is not responsible for any errors, omissions, or consequences arising from AI-generated responses, including but not limited to incorrect information given to your customers, missed or incorrectly booked appointments, or any business or reputational loss resulting from your assistant's behaviour.

You are solely responsible for:

• Configuring your assistant accurately and completely.
• Monitoring your assistant's responses on an ongoing basis.
• Ensuring the assistant does not make commitments on your behalf that you cannot honour.
• Correcting any errors that arise from AI-generated output.

The service is provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of liability

To the maximum extent permitted by applicable law, Bouwens Marketing Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, profits, data, or damage to your business or reputation, arising from your use of the service or from reliance on AI-generated content. Our total liability to you in any twelve-month period shall not exceed the fees you paid to us in that period.

11. Termination

You may terminate your account at any time via your dashboard. We may terminate or suspend your access immediately if you breach these Terms, without liability to you. Upon termination, your right to use the service ceases and we may delete your data after a 30-day retention period.

12. Governing law

These Terms are governed by the laws of the Netherlands. Any dispute shall be submitted to the exclusive jurisdiction of the competent court in Amsterdam, the Netherlands.

13. Changes to these Terms

We may update these Terms from time to time. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
